Balancing police powers with the protection of international human rights and fundamental rights for the last decades has been a matter of debate. More recently it has become contentious topic under the threats of terrorist activities and militant movements in many countries all over the world. Though the ultimate goal of a liberal society remaining the same, which is to respect and protect the basic rights for citizens and all human beings, an effective protection system is approached differently in different jurisdictions. Police, as a body of government employees trained in methods of law enforcement, crime prevention and detection, authorized to maintain the peace, safety and order of a community. They have been given the legal (statutory) powers to intrude upon human rights and fundamental rights in carrying out its tasks and duties. This eventually raises the question of rule of law and its impact and relevance in protecting human right and fundamental rights.

In the German legal system any intrusion upon a human right or fundamental right can only be legitimate if explicitly permitted by statutory law otherwise it has to be considered an infringement of such rights. The concept of constitutionally protected human right and fundamental rights has been stimulated and enhanced by the international recognition of human rights after WW II. Since then, in Europe, a very specific system of protecting human rights contiguous to national protection of fundamental rights has been developed under the European Convention on Human Rights (ECHR). In this context the European Court of Human Rights is for decades now functioning as a supra-national court systems accessible to all citizens of the Member States of the convention.

The protection and enforcement of human rights and fundamental rights, a rights based approach to the functioning of police, thus achieving the balance between granting necessary powers to the police while at the same time protecting individual human and fundamental rights, shall be the topic of the course.

The course will provide an indispensable guide to this burgeoning field of law. A certificate of attendance from the MNLU Mumbai and BSEL Germany will be awarded to those who have successfully completed the course.
